Information on the processing of your personal data, pursuant to article 13 of Legislative Decree no. N. 196/2003 regarding the protection of personal data.

DATA PROCESSING

Please note that, for the execution of the ongoing contractual relationship with you, our Company is in possession of information relating to you, acquired verbally, directly or through third parties, classified as "personal data" from D.Lgs.n. 196/2003. The legislation in question provides, firstly, for the one who performs the processing of personal data, the obligation to inform the person concerned which data are processed and for what purpose, which in any case must be treated fairly, lawfully and transparently, protecting your privacy and your rights. According to the provisions of art. 13 of Legislative Decree no. N. 196/2003, we provide the following information.

NATURE OF DATA
We process your personal and fiscal data and the data of an economic nature which are necessary for the performance of contractual relations with your company. We are not in possession of any data classified as sensitive or of a judicial nature in art. 4, paragraph 1, of Legislative Decree no. N. 196/2003.

PURPOSE OF TREATMENT
Your data will be treated in accordance with contractual requirements and to fulfill the legal and fiscal obligations, and to enable effective management of financial and commercial relations. The data will be processed for the entire duration of the contract and thereafter, for the fulfillment of legal obligations and for administrative and commercial purposes.

METHOD AND PURPOSE OF DATA PROCESSING.
The data processing is carried out by means of transactions or series of transactions referred to in Article 4 letter. a) Consolidated (collection, recording, organization, storage, consultation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, cancellation and destruction) and can be done either on paper or through electronic instruments.

OR OBLIGATION 'TO GIVE THE DATA CONSEQUENCES OF REFUSAL
With regard to the data that we need to know in order to fulfill the obligations required by laws, regulations and legislation or provisions issued by authority to do so by law and by the vigilance and control, their absence on your part will result in the impossibility to start or continue the transaction, to the extent that such data are required for the same. With regard to the data we are not obliged to know, their lack of achievement will be evaluated by us from time to time, and the resulting decisions regarding the importance to us of the data required and provided to us.

COMMUNICATION AND DISSEMINATION
Your data will not be with us "common", this being intended to give knowledge to indeterminate subjects in any way, including by making them available for consultation. Your data may however be "communicated", this being intended to give knowledge to one or more subjects in the following terms:

  • to persons responsible within our Company to process your personal data, and in particular the staff of the administration, to the Commercial Department employees;
  • subjects which can access your data based on the provision of law, regulation or legislation, within the limits set by such regulations;
  • to individuals who need to access your data for purposes related to the relationship between you and us, to the extent in order to to perform the tasks assigned them. In particular, they will have access to your subject by the specified below: credit institutions, professionals, shippers, agents of our network;
  • to our consultants, in order to perform their functions, subject to our letter of appointment clearly stating their duty of confidentiality and security in the processing of your data.

YOUR RIGHTS
Legislative Decree No.196/2003, Article 7 - Right of access to personal data and other rights
1. A data subject shall have the right to obtain confirmation as to whether or not personal data concerning him exist, regardless of their being already recorded, and communication of such data in intelligible form.
- 2. A data subject shall have the right to be informed
- a) of the source of the personal data;
- b) of the purposes and methods of the processing;
- c) of the logic applied to the processing, if the latter is carried out with the help of electronic means;
- d) of the identification data concerning data controller, data processors and the representative designated as per Section 5(2);
- e) of the entities or categories of entity to whom or which the personal data may be communicated and who or which may get to know said data in their capacity as designated representative(s) in the State’s territory, data processor(s) or person(s) in charge of the processing.
3. A data subject shall have the right to obtain
- a) updating, rectification or, where interested therein, integration of the data;
- b) erasure, anonymization or blocking of data that have been processed unlawfully, including data whose retention is unnecessary for the purposes for which they have been collected or subsequently processed;
- c) certification to the effect that the operations as per letters a) and b) have been notified, as also related to their contents, to the entities to whom or which the data were communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected.
4. A data subject shall have the right to object, in whole or in part,
- a) on legitimate grounds, to the processing of personal data concerning him/her, even though they are relevant to the purpose of the collection;
- b) to the processing of personal data concerning him/her, where it is carried out for the purpose of sending advertising materials or direct selling or else for the performance of market or commercial communication surveys.
